商品房买卖合同中惩罚性赔偿的法律适用

摘要:近几年来房地产买卖持续升温,商品房买卖随着社会发展日益增多,商品房买卖合同交易纠纷大幅度增加。其中开发商在合同履行中欺诈、违约行为严重的侵害到买受人的权益,而买受人作为弱势群体,难以文护自己的合法权益。为了保护买受人权益,最高人民法院于二〇〇三年的四月二十八日下发了《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》而该司法解释第八条、第九条中,把“惩罚性赔偿原则”引入到了商品买卖合同纠纷的处理之中来。另外在该《司法解释》第十四条也对该惩罚性赔偿作出了规定。通过高额的赔偿金额惩罚违法行为,这种方式能够有效地防止违法行为的发生。将相关法律引用到商品房买卖中是必要的,能更好的保障买受人的合法权益不受侵害。39843

Abstract:In recent years, the sale of real estate continues to heat up, with the sale of real estate increasing social development, a substantial increase in the sale of real estate transaction disputes.Where developers in the contract fraud, serious breach infringement to the interests of the buyer, but the buyer as a vulnerable group, it is difficult to protect their legitimate rights and interests.In order to protect the interests of the buyer, the Supreme Court on April 28 2003 under the issued a "Supreme People's Court on the trial of real estate contract dispute case law applicable to a number of issues," and that judicial interpretation eighth Article IX, the "principle of punitive damages" is introduced into the contract for the sale of goods to the dispute being processed.Also in the "judicial interpretation" of the Article XIV also makes provision for punitive damages.Punishment by the high amount of compensation violations, this approach can effectively prevent the occurrence of violations.The relevant laws refer to the sale of real estate is necessary, to better protect the legitimate interests of the buyer not infringed.

    商品房买卖随着社会发展日益增多,一些房屋出售人以恶意行为,欺诈行为谋取暴利。国家为了保护弱者权利不受侵害,出台相关法律最大限度惩罚了侵权行为人,通过高额的赔偿金额惩罚违法行为,这种方式能够有效地防止违法行为的发生。将相关法律引用到商品房买卖中是必要的,能更好的保障买受人的合法权益不受侵害。
     一、惩罚性赔偿概述
(一)惩罚性赔偿的起源以及发展
根据资料追溯惩罚性赔偿的来源,最早出现的国家应该是英国,它最早被提出是在一个英国民事案件中,但是这一制度并没有被英国重视,而首先确立这一制度的国家是美国,在美国这一制度最早出现在侵权领域中,并得到了广泛运用,同时随着它的广泛运用争议不断。在《美国侵权法》中有阐述,惩罚性赔偿在惩罚被告不法侵害的同时,更大的限度补偿受害人,基于高额赔偿它能够威慑抑制不法侵害的产生,从而减少不法侵害的发生。 (责任编辑:qin)
