摘要我国《专利法》第三次修改后，在二十三条引入了外观设计的抵触申请制度，外观设计 专利的审查标准得以提高，但修改后的《专利法》却将发明、实用新型排除在外观设计专利 申请的抵触申请之外，亦将外观设计排除在发明、实用新型专利申请的抵触申请之外。结合 抵触申请规则在司法实践中的具体运用，有必要对外观设计与另两种专利申请之间能否互为 抵触申请进行探讨并进行重新界定，以便更好地维护在先申请人的利益以及公众利益，以及 在业界形成统一规范来避免后续纠纷。89158
