摘 要虚假诉讼不但扰乱了我国的司法秩序，也给第三人利益造成了巨大的损失，笔者通过发放调查问卷和以桐乡市人民法院为例进行调研发现，虽然虚假诉讼的案件有逐年递增的趋势，但是法院目前仍旧欠缺一套完备的虚假诉讼审查识别制度来规制虚假诉讼。因此，笔者结合桐乡市人民法院对虚假诉讼审查识别的特有方式，认为审查识别虚假诉讼首先应当从案件类型和虚假诉讼的特征来识别虚假诉讼案件，警惕虚假诉讼集中的几类案件类型；其次应当明确虚假诉讼的审查主体，提高办案法官的审查能力；还应当完善群众监督举报机制；最后完善民事诉讼法中关于虚假诉讼的规定以及可在刑法中规定对虚假诉讼的刑事制裁。90008
Abstract The false litigation not only disrupt the judicial order in our country, also caused huge losses to the third person interest, the author through questionnaires and the research the people’s court in Tongxiang, finding that although false litigation case has increasing trend year by year, the court is still lack of a complete set of false litigation review recognition system to regulate false action。 Therefore, the author combined with the people's court in Tongxiang on false litigation review recognition characteristic way, review to identify false litigation shall start from the first case types and the characteristics of the false action to identify false lawsuits, guard against false litigation concentrated a few types of cases; The second shall specify the review of the false lawsuit main body, improve the ability of the judges review; also should improve the populace to supervise mechanism; Finally perfect the provisions on false litigation in the civil procedure law and in the criminal law stipulated in the criminal sanctions against false action。
