摘  要我国地大物广，各地方的风俗习惯存在地域、时间等差异，村民制度必有其不完善和缺点。村规民约是在农村建立自治制度下，通过将风俗习惯经村民民主表决所产生的规范性文件。而国家的法律文件，依其强制性，也影响着广大农村地区。在村民利益多元化的今天，法律与村规民约的关系值得探析，以便于做出应有的评价和合适的建议。作为作者熟悉的家乡，从浙南的一个小村庄两个具体案例探析法律规范与村规民约的关系。90104
