摘要 上市公司推行股权激励制度，授予员工股票期权。在离婚诉讼中，法院对于股票期权的性质认定不一；根据获权以及行权时间与婚姻关系存续期间的关系，法院对于其是否应当归属于婚姻财产的范围认定不一；法院对离婚诉讼时处于未行权状态的股票期权，一般采取等到行权时，当事人再另行起诉请求分割股票期权收益的方式。而美国认定股票期权为婚姻财产并且在财产分割诉讼中，以双方对婚姻生活的贡献为主作为划分股票期权的标准，不考虑是否行权。相比之下，我国对离婚诉讼中股票期权的分割具有落后性。本文主要确定股票期权的性质，判断股票期权是否应当归属于婚姻财产以及完善股票期权的分割三方面。90144

    Public companies carry out the equity incentive system to give stuffs stock options。 In the porce proceeding, the property of the stock option is uncertain。 What’s more, whether stock option is community property or not according to time of gaining and exercising is also uncertain and comprising with America whose law considers stock option as community property and gives priority to with both sides' contribution to the marriage as a standard of piding stock options, not to consider whether to exercise in the lawsuit of the pision of property, Chinese law stipulates stock option income can be pided until the time of exercising which has its historical lag。 Therefore, this article states from three aspects。 First, ensuring the property of stock option。 Next, judging whether stock option is community property or not。 Finally, completing the segmentation of stock option in the porce proceeding。
