摘要现如今人口老龄化以及社会飞速的发展都使得退休制度渐渐成为当今社会人们最关心的问题。作为一项社会制度，退休制度一直都在保障个人的生活。作为人口最多的发展中国家，我国对此方面更是尤其关注。当然完善退休制度也是最能够保障劳动者的权利的。本文主要分为四个部分。第一部分是引言。第二部分是对退休及退休制度的基本内涵所做的解释，根据已有的学说基础上，笔者自己加以概括而得出本文中的相关概念；其次，在将我国退休制度的发展做了梳理，希望能够更加直接的了解到其发展历程。当然再提出我国现阶段的退休制度主要存在的问题以及争议的焦点。第三部分是将国外的一些关于退休制度的相关方面列举出来，在此基础上笔者对于我国现阶段的退休法律制度提出了一些建议与意见。33723

Title Research on the legal system of retirement
Abstract
An aging population and rapid development of society now makes retirement system gradually become a problem in today's society, people are most concerned about. As a social system, the retirement system has been in the protection of inpidual life. As the most populous developing country, China is particularly concerned about this aspect. Of course, the most perfect retirement system to protect the rights of workers. This paper is pided into four parts. The first part is an introduction. The second part is to explain the basic connotation of retirement and retirement system made according to the existing theory, based on the author to summarize and draw their own concepts in this article; secondly, in the development of our retirement system to do a comb the hope of a more direct understanding of their development process. Of course, then China's current retirement system proposed major problems and the focus of controversy. The third part is to enumerate some relevant aspects concerning foreign retirement system, based on the author for the retirement law System in China made a number of suggestions and comments.
