摘要：2001年婚姻法修正案明确确立了离婚损害赔偿制度，适用十多年以来，真正保护了夫妻中没有过错一方的合法权益，惩罚了过错一方。可是，在实践过程中，问题随之而来，曾现出各种各样的状况，导致某些学者建议以新的制度取代离婚损害赔偿制度。为什么大家期望很高、花费太多心血的法律作用不大，为解开该制度的原本面目、加快离婚损害赔偿诉讼的良好实行，用民事诉讼法的基础核心理论作为重点对离婚损害赔偿诉讼解析。从细微入手，从实体法与程序法的互动中寻找离婚损害赔偿诉讼的原本面目。经过一系列考较后，提出了完善离婚损害赔偿诉讼的一些意见，希望能使其良性运转。39278

Elementary Analysis of System of Compensation for Divorce Damage
Abstract：Clearly established the system of compensation for injury of porce, the Amendment of 2001 Marriage Law,for 10 years, has authentically protected the legal right of the innocent in the marriage and punished the party in fault.However, in practice, there are also some problems has aroused. The various situations appeared has led to some scholars' propose of suggestions to replace the porce damage system with a new system.We highly expected the law and devoted relentless efforts in it. But why it doesn't work ? In order to reveal the true nature of the system and accelerate the good application of the porce suit, the paper focus on the basic theory of the Civil Procedure Law and then makes an analysis of the porce damage suit . From details, it attempts to find the essence of the porce damage suit from the interaction between the substantive law and the procedural law. Based on a series of comparison, the paper finally propose some suggestions to improve the porce damage suit system, and we all hope that it contributes to a favorable operation.

前言
随着我国的飞速发展，人们的生活水平愈来愈好，本来夫妻关系也应该越来越好，可是我国的离婚案件近几年却曾上升趋势，社会上情妇、二奶等现象越来越普遍，结婚后和别人同居，更有甚者再结婚，严重影响了婚姻关系的稳定，故保护受害方的权益就十分重要了，婚姻损害赔偿制度的设立恰好解决了这个问题，可是随着制度的实施和运行，问题随之而来。
