网络谣言犯罪刑法规制

摘要：信息科技的发展造成网络谣言犯罪率的不断攀升，而国家对网络谣言犯罪仍无专门立法。司法实践因无专门法律可依而以其他的罪名去定性网络谣言犯罪，此举也往往造成错判和漏判，损害了公民的合法权益，同时也严重扰乱司法秩序。我们目前实践中关于网络谣言犯罪的案例涉及到的罪名有寻衅滋事罪、非法经营罪、诽谤罪、敲诈勒索罪。这些案件中所涉及的罪名用以定性网络谣言犯罪部分是合法有据的，但也有不妥之处。为了维持好的司法秩序，保障公民的合法权益，完善网络谣言犯罪的处理方法迫在眉睫。本文结合司法实践以及网络谣言犯罪的不同特点进行解释，确定刑法中哪些罪名可以用来处理网络谣言犯罪。53530

Abstract: The development of information technology results in the constant rising of internet rumors’ crime rates, while our country still has no specific legislation on the internet rumors crime. Because there is no specific law to abide by, judicial practice may determine the nature of internet rumors’ crime rates with other charges, such kind of act often results in erroneous judgment and false negative, which damages the legitimate rights and interests of citizens as well as seriously disturbs the judicial order. At present, the cases in practice with regard to internet rumors’ crime rates involve charges of crime of picking quarrels and provoking troubles, crime of illegal business operations, crime of defamation and offence of extortion by blackmail. Using the charges involved in these cases to determine the nature of internet rumors’ crime rates is partially legal with evidence, but there are also some inappropriate points. In order to maintain judicial order well and protect the legitimate rights and interests of citizens, it is extremely urgent to improve the handling method of internet rumors’ crime rates. This paper conducts explanation combining judicial practice and different characteristics of internet rumors crime, and confirms what charges in criminal law can be used to deal with internet rumors crime.
