摘 要： 被害人承诺是指特定法益主体在自己能够正确认识所支配的相关法益的前提下，做出允诺以许可他人对自己所放弃的法益进行侵害。一般来说，受骗情况下的被害人承诺由于并不是被害人的真实意愿反映，因此原则上不可以阻却违法性。但在动机错误的情形下被害人承诺能否阻却违法则一直存在争议。本文对动机错误情形下的被害人承诺的违法性阻却事由的研究，主要是对不同的学者观点进行分析，归纳出基于动机错误的被害人承诺能否阻却违法性并不能一概而论，需要结合具体情况。并结合国内外立法实践，提议把不能阻却违法的被害人承诺以具体罪名的方式入罪，以此将被害人承诺纳入法律规范。56179

Abstract: Victim is the main benefit of a specific law on the premise that they can correctly understand the relevant law dominated benefits, making promises to permit others to give up their own legal interests be infringed. Generally, in case of the victim being cheated because the commitment to reflect the true wishes of the victim is not, in principle, can therefore negates the illegality. But in the case of victims of the wrong motive negates the offense is committed whether there has been controversy. This paper studies the victim of unlawful sexual motive negates commitments under the wrong circumstances, mainly on the different viewpoints of scholars analyze, summarize the wrong motives based on whether the victim negates the illegality committed and can not be generalized, requires a combination of specific circumstances. Combined with domestic and international legislative practice, the proposed law negates the victim can not be committed to specific offenses incriminating way, this will be the victim commitments into legal norms.

引言
被害人承诺，又称权利人承诺、被害人同意，即指被害人允许他人对自己的权益实施侵害。我国在刑法上对被害人承诺并没有做出明确规定，只是作为超法规的违法阻却事由来进行研究的。一般来说被害人承诺被定为由于法益主体对自己有处分权的利益的放弃从而免除行为人犯罪的违法阻却事由。这体现了刑法的谦抑性。这种得承诺而实施的行为需要满足一系列主客观和时间上的条件才能阻却违法或同时阻却构成要件该当性。基于动机错误的被害人承诺能否阻却违法则一直存在争议。我国目前通用的刑法理论一般认为，单纯的动机错误并不能阻却承诺的成立，即这种情况下的被害人受骗承诺仍然可以阻却违法。但笔者则认为即使是在单纯的动机错误下的被害人承诺能否阻却违法也需要视情况而定。因此本文对基于动机错误的被害人承诺能否阻却违法的研究，主要是对不同的学者观点进行分析并提出自己观点。源'自:优尔-'论/文'网"www.youerw.com 基于动机错误的被害人承诺能否阻却违法:http://www.youerw.com/faxue/lunwen_60677.html
