摘要：本文从司法实践中的两则案例引入，表明在实践中原被告的举证责任标准多元化，与法律规定的一般原则“被告对具体行政行为的合法性进行举证”的单一规定形成冲突。目前的理论研究也仅是笼统地将不作为案件进行举证责任的划分，并没有对不同类型的不作为案件进行细化，导致法律的单一规定难以满足实践的需要。因此，本文通过区分不同类型的不作为案件，解决我国目前行政诉讼中单一化模式下的举证责任与多重化举证责任标准的冲突，分析不同类型案件的特点，细化不同类型行政不作为案件的举证责任分配。58884

Abstract:Current “administrative produre law”regulation,”the defendant make the legality of specific administrative act to its,bear the burden of proof”,but how to sue administrative nonfeasance and other litigation cases in the distribution of burden of proof,the law does not make that clear.Our county’s current administrative procedure law,the regulations on administrative inaction cases the burden of proof allocation is too single,but in judicial practice,is present as a case the burden of the persity of allocation.Proceeding of its reason,lies in the administrative litigation judgment under the system of single mode with different types of administrative inaction cases in judicial practice content of distribution of evidential burden of different conflicts.Through different types of administrative inaction cases,as well as the characteristics of different types of cases,refine the burden of proof distribution of different types administrative inaction cases.

1 前言

目前，理论界对行政不作为诉讼的举证责任理论研究比较少，且大多集中于对举证责任的含义、效用和特性进行研究，并不能有效指导司法实践和深化理论研究。因此，本文从现实中的真实案件着手，反思我国现行行政诉讼举证责任相关规定中存在的不足，简要分析不同类型的行政不作为案件的举证责任分配，进行分类研究，以期对审判实践有所裨益。
