摘 要：我国经济高速发展的同时，由于环境问题引发社会大范围的纠纷成倍增加。在解决环境纠纷的过程中，公众试图寻找各种途径与机制，而司法途径是其中最受到公众重视的一种途径，构建环境司法专门化成为一种必然的选择。本文将从历史考察与对比分析的角度出发，对我国及国外环境司法专门化的发展、现状等方面进行分析。对我国环境司法的形式及个别地方的环境司法专门化实践进行判断，并且分析国外环境司法专门化的发展历程及整体现状，从产生背景、性质、地位等方面分析国外主要国家环境司法专门化现状，进行经验总结，从而为我国的环境司法专门化提出有益的建议。66602

Abstract: The rapid development of China's economy at the same time, due to environmental problems caused by social widespread disputes doubled. In the process of solving environmental disputes, the public tried to find various ways and mechanism, and the judicial way is one of the most affected by a way of public attention, construction of specialized environmental justice becomes a kind of inevitable choice. This paper starts from the analysis of historical and comparative perspective, specialization of judicial environment in our country and abroad, the development, status and other aspects of analysis. The environment of our country judicial form and the inpidual parts of the specialized environmental justice practice judgment, and analysis of the development and the overall situation of foreign specialized environmental justice, environmental justice analysis of major foreign countries specialization status from the background, nature, status, summarized the experience, which is China’s environmental justice special put forward beneficial suggestions.

1 引 言
作为全球人类共同面对和关注的热点话题，环境问题长期困扰着世界各国，全球变暖、臭氧层破坏、森林资源锐减、土地荒漠化等等，都时刻威胁着全人类与社会的生存与发展。我国作为最大的发展中国家，其高速发展的经济背后存在着许多问题，特别是环境隐患。 其实在改革开放之后我国就只是在一味的追求经济发展，甚至牺牲公众的环境权益来换取暂时的高经济增长速度。近年来，在我国，环境污染事故频繁发生，无形当中存在许多污染隐患，经常发生一些突发性的污染事故。最近的就有延安市的长庆、延长石油集团的原油泄漏事件。在这样的背景下，我国的政治文明不断提高，法制建设不断进步，民众的自主维权意识逐步加强，对于长久以来的环境污染问题，民众通过环境诉讼来维护自身权益的案件也在不断增多，因此需要对当前的环境法律制度加以完善和改进。 我国环境司法专门化问题研究:http://www.youerw.com/faxue/lunwen_74570.html
