摘要：公众参与制度是城乡规划中的一个重要环节。德国1976年在城市规划基本法《联邦建设法》将公众参与制度以法律形式确定下来。在中国，公众参与制度在城乡规划中一直是热议话题。本文以中国和德国为视角，通过经典案例分析中国的现状和存在的问题，同时学习德国的制度以及经验，为中国城乡规划法中的公众参与制度的完善提供借鉴。72954

On the public participation institution in the urban and rural planning law

Abstract: The institution of public participation is an important part of the urban and rural planning。 The public participation institution had been determined by Federal Construction Law which is the German basic law of urban planning in 1976。 In China, the institution of public participation in urban and rural planning has been a hot topic。 This article takes China and Germany as the angle of view, analyzing China's current situation and existing problems by the classic case。 At the same time studying the German institution and experience, providing references for the improvement of the public participation institution in the urban and rural planning law of China。

一、引言

公众参与制度一直有很多不同的理解，主要有以下几种观点：1、斯凯夫顿认为，公众参与是指公众和政府共同制定政策、议案的行为 。真正充分有效的参与是公众能够以高度的热情参与整个规划的制定过程。2、雪莉。R。阿恩斯坦认为，公众参与表示的是公众权利，是权力的重新分配，经过重新调整能够使原本没有权力、当前被政治和经济进程中所排斥的一些公众拥有参与城乡规划程序的权力；同时他认为公众参与是一种信息决策的战略，经过这个过程，一些本来没有权力的公众能够决策城乡规划，可以积极地为城市发展做出贡献 。3、城市规划学者约翰。费里德曼认为，公众参与是一种过程，是公众对政府工作决策以团体形式参与的过程 。 论城乡规划法中的公共参与制度中国和德国为比较对象:http://www.youerw.com/faxue/lunwen_83083.html
