摘要：我国的宪法40条规定了公民的通信自由和通信秘密受法律的保护，但是在互联网高度普及的新时代新形势下对网络隐私权的保护提出了更高的要求。本文以网络隐私权为研究对象，分析了目前学界对网络隐私权界定和定性的几种观点，笔者赞同的观点是，网络隐私权既包含了传统隐私权固有的人格权属性又含有新的财产权属性，是一种复合型人格权。文章还列举了网络隐私权的保护现状和存在的问题。主要包括：隐私权没有独立的法律地位、法律保护体系的缺失、互联网行业自律还存在漏洞。最后提出了确定隐私权的独立人格权地位、建立健全隐私权法律保护体系、完善行业自律等措施。79179

Legal Protection of Privacy

Abstract: Thanks to the economy and the rapid development of science and technology， and application of Internet technology began to spread to millions of households。 More and more people use the Internet as the world， communicate with others and communication tools。 Internet technology in great convenience to people's lives， to narrow the distance with the world and also brought some negative effects， namely network privacy issues。 People use certain tools can easily steal important information to Internet users。 Some sites trafficking in personal information of serious incidents are endless。40 Our Constitution provides for freedom and citizens' secrets protected by law， but in the new era of the new situation on the network privacy protection put forward higher requirements。 In this paper， network privacy for the study， analysis of the current status of the network protection and privacy issues。 Including： lack of relevant legal protection system， punishment is not enough， not strong sense of personal privacy and other issues； to establish a sound legal protection system， increase penalties， increase awareness of personal protection measures。
