摘要随着经济全球化的发展，原产地规则不只是海关的技术性问题，而且也成为各国实施贸易政策措施的工具，也越来越多地用于国内产业的保护。其在国际经贸领域发挥着越来越重要的作用。自从改革开放以来，我国也制定了有关原产地规则方面的法律，并不断完善。我国在运用原产地规则方面已经取得了显着成就，但仍存在诸多问题，影响了我国经济特别是对外贸易的发展。因此，对原产地规则进行探讨，无疑具有重要的时代意义和实证价值。本文试就原产地规则在我国的适用作一阐述，并根据存在的问题对我国原产地规则的完善提出建议。9530

Title An Analysis of the Usage and Improvement of Rules of Origin in China
Abstract With the development of economic globalization, rules of origin are not only the technical problems of the Customs, but also used as instruments of trade policy by many countries and for the protection of domestic industries more and more. Rules of origin play an increasingly important role in the field of international trade. Since the reform and opening up, China has also formulated the laws of ROOs and continues to improve. China has made remarkable achievements in the application of rules of origin, but there are still many problems affecting China’s economy, especially development of foreign trade. Therefore, it has important significance of the times and the empirical value to discuss the rules of origin. The article tries to make an elaborate on the application of ROOs in China, and puts forward recommendations on the improvement of China’s rules of origin in accordancce with the existing problems.

1 引言
当“中国制造”被越来越多的经济学家挂在嘴边的时候，很少有人去研究，那些贴着“中国制造”标签、从中国流向世界各地的产品，到底有多少部分是完全产自中国的，这里就涉及一个重要的贸易规则——原产地规则。
该规则产生于20世纪初，当时确定产品原产地主要用于两个目的：一是用于实施海关税率，另一个就是进行海关统计。随着WTO的不断壮大与完善及国际贸易的发展，原产地规则还不断用于实现其他目的，如反倾销、反补贴、配额限制、保障措施等，其本身已从一种技术手段发展成为实施贸易政策、文护区域贸易利益的重要工具，背后隐藏着重要的国家利益关系。 试析原产地规则在我国的应用及其完善:http://www.youerw.com/jingji/lunwen_8282.html
