摘要:现今社会诚信缺失,代言这种依靠信誉做出的行为,由于社会影响广、数量多,对代言人的责任引人思索,趁着《广告法》修订之际研究研究。除了前言外,共分为四部分。前言,通过掌握的知识浅谈代言,讲述代言现状;第一部分,分析代言的含义和构成要件,了解什么是代言;第二部分,通过分析代言合同的性质,分析代言人通过劳务在代言作品中的意思表示,认定代言合同拥有担保性质;第三部分,分析学说的分歧和法律存在的问题;第四部分,根据代言合同性质要求代言人承担担保责任,找到学说中的平衡点,提出对法律的构想,用激进的思想,通过中庸的手段解决代言人问题。39548 毕业论文关键词:代言人责任;担保责任;意思表示
