摘  要：伴随着网络媒体的迅速发展，微博逐渐成为一种新兴的传播媒体在人们的生活中迅速“走红”。微博的出现为人们提供了一个全新的交流平台，方便、快捷、大众、自由、开放等这些特点让微博更轻易更快速地成为当前社会最为流行的网络媒体之一，但同时也正是由于它的这些特点更容易导致矛盾的产生，尤其是法律问题的凸显。其中主流媒体对公众知情权的限制，微博传播毫无限制的随意性以及微博用户自身缺乏自觉性这三个方面是造成这种局面的主要原因，并找到解决微博中言论自由带来负面影响的主要途径有加强主流媒体的公信力，提高微博运营商的行业自律和利用法律约束微博用户。以此来引导公民在微博中正确行使言论自由，充分发挥公民行使言论自由的自觉性，从而进一步改善微博的交流环境。4539

On Freedom of Speech from Microblog Perspective
Abstract: With the rapid development of network media, Sina Weibo is becoming an emerging media and rapidly popular in people's life. The emergence of microblog provides people with a new communication platform, whose characteristics of convenience, popularity, freedom and openness make microblog more easily and quickly become the one of the most popular network media in the current society. However, these characteristics also can more easily lead to contradiction, especially the legal problems. Among them, the mainstream media’s restriction on the public’s right to know, the unrestricted randomness of microblog spreading and the microblog users lack of self-consciousness are the main causes of this situation, and there are also some main ways to be found to solve these negative effects caused by microblog’s freedom of speech, including to strengthen the credibility of the mainstream media, to improve microblog operators’ industry self-regulation and to restrain the user of microblog by law, which in order to guide how the citizens exercise freedom of speech on microblog, give full play to the citizens’ consciousness of exercising their freedom of speech, so as to further improve the communication environment of microblog.

论微博视角下的言论自由
经济社会的发展导致一系列网络媒体推陈出新。以“零进入门槛”和草根本质为突出特点的新兴网络交流平台——微博的兴起，催生了大众传播的繁荣，使受众享有前所未有的言论自由。无论是哪种身份的公民，都能在微博中畅所欲言，表达自己最内心的想法。然而言论自由的广泛行使却使一些有害言论有机可乘，利用这一平台危害社会。近段时间，随着微博的逐渐普及，越来越多由于言论过于自由而引发的一系列社会问题，侵犯公民的隐私权、人格权等基本权利，这不得不引起我们的重视和思考。我们在最大限度的扩张言论自由范围的同时也需要采取一些必要的手段来限制言论自由，避免言论自由泛化造成的社会危害。 论微博视角下的言论自由:http://www.youerw.com/xinwen/lunwen_1276.html
