摘要：不动产善意取得制度是民法物权制度中的一项非常重要的制度，《中华人民共和国物权法》第一百零优尔条对不动产善意取得制度进行了明确的规定，这一制度的确立对于保护交易的安全、保护善意第三人的合法权益、文护交易的秩序有着非常重大的意义，同时也符合我国目前的基本国情。但是也存在着一些不太完善的地方，本文就不动产善意取得制度中存在的问题提出自己的看法，诸如应采取“不知且不应知”的善意标准和制定关于“以合理价格转让”中“合理价格”的标准等等，以期待我国善意取得制度的不断完善，顺应社会主义法治理念发展的要求。24626

Abstract:Real estate system of good faith is a very important system in civil law system of real right, the law of the People's Republic of China property law "the one hundred and sixth on the system of real property in good clear rules, the establishment of this system for the protection of transaction security, protect the lawful rights and interests of a third person in good faith and maintaining trading order is of very important significance, also conforms to the basic national conditions of our country's at present. But there are some not perfect place, in this paper, the problems in the system of real property in good proposed own view, such as "I do not know and should not be" should be taken to goodwill standards and set about "at a reasonable price transfer" in the standard of "reasonable price" and so on, to look forward to the continuous improvement of the good faith system in our country, comply with the demands of the development of the socialist concept of rule of law.
