摘要：在法治国家的建设过程中城乡一体化发展尤为重要，而城乡一体化发展首当其冲的就是城乡规划，不能仅局限于过去规划立法的老理念，需要紧跟发展需求，结合新的五大发展理念，完善整体规划立法。而要想作好城乡规划必须坚持立法先行，提高立法质量。本文首先从立法含义、体系、发展历史三方面，结合了代表性城市的具体立法状况对整个城乡规划立法体系展开概述。再针对《城乡规划法》现存的典型问题，探讨我国现行城乡规划立法问题所在。并通过学习外国立法经验，总结出解决问题的主要对策，改善现行立法体制，紧跟时代发展趋势展望适合中国特色的具有科学性、民主性的立法蓝图。94394

China's urban and rural planning problem analysis of the legislation

Abstract: The development of urban and rural integration is particularly important in the process of building the rule of law, and urban and rural development is the first urban and rural planning。 It can not be confined to the old idea of planning legislation in the past。 It must follow the development needs and combine with the new five development concepts , Improve the overall planning legislation。 And to make urban and rural planning must adhere to legislation first, improve the quality of legislation。 This article first summarizes the whole rural and rural planning legislation system from the three aspects of legislative meaning, system and development history, and combines the specific legislative situation of representative cities。 And then for the "urban and rural planning law," the existing typical problems, to explore China's current urban and rural planning legislation。 And through the study of foreign legislation experience, summed up the main countermeasures to solve the problem, improve the current legislative system, closely follow the development trend of the times for the Chinese characteristics of the scientific and democratic legislation blueprint。
