摘 要：“人肉搜索”起源于猫扑网，是一种区别于机器搜索的将隐藏的信息暴露于公众面前的搜索行为。互联网技术的发展与网民的大力参与是其迅速壮大的主要因素。“人肉搜索”虽有助于弘扬正义，进行道德批判并且能够起到舆论监督与制约的作用。但是随着时代的进步，不良“人肉搜索”频繁引发恶意侵权，致使网络暴力严重干扰到我们的正常生活。我国互联网技术起步晚，对其法律规制不够系统完善，加上自身固有的滞后性，导致不良“人肉搜索”侵权日益激烈。借鉴欧美国家实践经验，从立法完善和加强网络运营商的自治着手，对“人肉搜索”进行有效遏制，更好地服务于社会，文护公民的合法权益。40188

Study on the legal issues of human flesh search
Abstract:Human flesh search originated from the mop net,is different from the search behavior of machine search will expose the hidden information in front of the public.The development of Internet technology and Internet users strong participation is a major factor in its rapid growth.Human flesh search is helpful to promote justice,moral criticism and can play a role of supervision and restriction of public opinion.But with the progress of the times,the bad human flesh search caused frequent malicious infringement,resulting in the network violence seriously interfere with our normal lives.China's Internet technology started late,the legal regulation is not perfect,coupled with the inherent lag,caused bad human flesh search infringement increasingly fierce.Learning from the practical experience of the Europe and the United States ,from legislation to improve and strengthen the network operators autonomous hands,the human flesh search for effective control,better service to the society,safeguard the legitimate rights and interests of citizens.

21世纪以来，随着互联网技术的迅猛发展，网络交往也慢慢渗入我们的生活。在网络技术给我们的生活带来便利的同时，其自身缺陷也会给我们带来一定的困扰：泄露私人信息，网络中的侮辱、谩骂，甚至是干扰到正常生活。然而自从“死亡博客”事件以来，不良“人肉搜索”引发的侵权案件数不胜数，形势愈演愈烈。正是由于我国法律规制的不完善，对“人肉搜索”的界定不明确，网络隐私权的立法缺失，同时又缺乏社会正确价值观的引导，使得“人肉搜索”逐渐转化为“网络暴力”。虽然外国并未有“人肉搜索”一词，但对互联网的引导却是各国应解决的问题。不良“人肉搜索”对社会稳定是一个巨大的威胁，它将公民置于一个恐惧、未知的世界，也是对法治的恶意挑衅。“人肉搜索”并不完全可取，应当对其进行正确的引导。 人肉搜索法律问题研究:http://www.youerw.com/faxue/lunwen_38441.html
