摘要：近几年来房地产买卖持续升温，商品房买卖随着社会发展日益增多,商品房买卖合同交易纠纷大幅度增加。其中开发商在合同履行中欺诈、违约行为严重的侵害到买受人的权益，而买受人作为弱势群体，难以文护自己的合法权益。为了保护买受人权益，最高人民法院于二〇〇三年的四月二十八日下发了《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》而该司法解释第八条、第九条中，把“惩罚性赔偿原则”引入到了商品买卖合同纠纷的处理之中来。另外在该《司法解释》第十四条也对该惩罚性赔偿作出了规定。通过高额的赔偿金额惩罚违法行为，这种方式能够有效地防止违法行为的发生。将相关法律引用到商品房买卖中是必要的，能更好的保障买受人的合法权益不受侵害。39843
