摘要：房产限购政策催生了这样一种现象：一些夫妻把婚姻作为一种获利的“工具”，通过通谋离婚达到避税以及逃避二套房贷限制的目的。通常所说的通谋离婚即指夫妻双方为了共同或各自的目的而合谋作出虚假的离婚合意，等目的达到后再行复婚的离婚行为。对于通谋离婚的离婚效力，我国法律尚未作明确规定，本文从房产限购的视角，认为通谋离婚购房的离婚效力原则上无效，例外情形下有效。而房屋买卖合同在一些情况下无效，在多数情况下有效。对此，本文也深入思考，建议从实体和程序两方面不断完善，以减少此类情况的发生。54117

Abstract: Real estate purchase limit policies have resulted in a bad phenomenon that some couples consider marriage as a profitable "tool", by conspiring porce, they achieve the goals of two sets of mortgage tax avoidance and evasion of limitation. The conspiracy porce is commonly referred to the action that spouses make a false-rigging consensual porce for a joint or respective purpose and remarry after the purpose is reached. Presently, Chinese law has not defined the effectiveness of conspiring porce. From the perspective of real estate purchase, the author thinks that the effectiveness of conspiring porce is invalid in principle but valid under exceptional circumstances; in some cases the sale of housing is invalid but valid in most cases. Therefore, the author also takes a deep thought, suggesting continuous improvement in two aspects: entity and procedure, to reduce the occurrence of such phenomenon.

引言

离婚对于感情破裂、无法共同生活的夫妻无疑是一种解脱方式。但随着我国改革的深化，市场经济的发展，以及人们在思想意识形态上的变化，一些夫妻滥用法律所赋予的离婚自由权，通过通谋离婚规避政策、法规所要求的义务，达到非法目的。这给婚姻当事人双方、亲属以及社会甚至国家利益都带来了负面影响，我们有必要从法律视角来探讨此问题，找出解决方法以更好地规制它，减少不必要的损失。
