摘 要：现实生活中，夫妻一方以个人名义对外举债的现象屡见不鲜，对于所举之债的性质究竟是属于夫妻共同债务还是夫妻个人债务，无论是在理论界还是司法实践中，都观点不一。《婚姻法司法解释（二）》将婚姻关系存续期间夫妻一方以个人名义对外所举之债推定为夫妻共同债务，值得肯定的是该推定规则对于维护债权人的利益具有一定的积极意义，但司法实践中对于夫妻共同债务的认定仍存在着问题。本文通过分析问题背后的原因，进而针对这些问题从立法层面、当事人和法官角度提出了具体的举措。54308

Abstract：At present, the phenomenon that one of the couple does external finance personally is commonplace. But now there are two views in the cognizance of the theory circle and the judicial practice on the debt owed by a party in the duration of the marriage: one side regards it as the couple's joint debt, the other side regards it as personal debt. In principle, Interpretation of the Marriage law in china deems that the debt owed by a party in the duration of the marriage is the couple's joint debt. The rule has its positive significance on protecting the interests of the creditors, but still has some problems about the couple's joint debt in the judicial practice. I study the reasons of these problems. And put forward some countermeasures which relate to legislation, participants and judges to solve the problems.
