故意“误拆”的定性与对策

摘要：近几年来，“误拆”事件频频发生，相关报道也层出不穷，事实上，所谓的“误拆”大多数都是拆迁方故意为之，只是想规避强拆的责任和刑罚，从而导致拆迁方把“误拆”当成强拆的借口。“误拆”行为不容忽视，从构成故意毁坏财物罪的构成要件来分析，故意“误拆”所造成的损失在达到我国法律明确规定的定量标准，就可能构成故意毁坏财物罪。本文主要以南京邮局被拆案为切入点进行研究探讨。找出故意“误拆”事件屡禁不止的根本原因。并认为应该修改信访属地管辖原则、建立有效的监督体系和完善相关法律等对策，减少甚至杜绝故意“误拆”事件的发生。56190

1引言

随着中国经济的快速发展，各地对土地的需求程度越发的加大，政府和人民群众开始了“土地争夺战”。再加上现今房价的上涨又使得许多人想凭借拆迁补偿而一夜暴富。这种情况下，政府要与拆迁户达成一致意见是很难办到的。钉子户漫天要价，政府根本满足不了，即使能满足，其他人也一样要享受相应的待遇。而“误拆”就成了对付“钉子户”的绝佳办法，这一借口，又能很好的规避掉法律责任，因此，“误拆”事件屡禁不止，愈演愈烈。故意“误拆”的定性与对策:http://www.youerw.com/faxue/lunwen_60692.html
