摘 要：电子网络的发展导致知识产权的保护现状日益严峻，频频出现影响较大的网络侵权纠纷，而域名与商标的冲突就成为其中的典型代表之一。由于传统的知识产权保护制度不够健全，无法对这一问题进行规制，相关的权利主体很难通过普通方式获取充分的救济，所以正确认识域名的知识产权属性，通过对域名纠纷案例的分析以及国内外对域名保护的相关规定发现我国域名保护在知识产权保护中的缺失之处，并且借鉴国外域名保护规定从知识产权角度对我国的域名保护方式提出新的设想和建议。56719
Abstract：The development of the electronic network protection present situation of intellectual property rights are becoming more and more serious, influence of network infringement disputes, and the conflict between domain name and trademark has become one of the typical representative. Due to the traditional intellectual property protection system is not sound, not the problem of regulation, the rights of the relevant subject is difficult to get adequate relief by way of ordinary, so the correct understanding of the domain name of intellectual property rights attribute, through the analysis of the domain name dispute cases at home and abroad as well as the rules of domain name protection found that the domain name protection in China in the absence of protection of intellectual property rights, and draw lessons from foreign domain name protection of domain name in China from the Angle of intellectual property rights protection way put forward new ideas and Suggestions.

1 引言
