摘  要：随着我国网络购物等的日渐兴起，网络第三方支付平台迅速发展起来，相比于现有法律对传统支付机构的严格法律规制而言，我国网络第三方支付的法律规制还存在很大的不足，这对于网络第三方支付法律风险的约束不力。本文研究立足我国实际情况，对网络第三方支付的内涵、特点进行介绍，重点对我国网络第三方支付的法律现状进行分析，明确在目前法律体系下存在的漏洞及原因。进而，针对当前我国网络第三方支付法律缺陷的现实情况，构建针对性解决方案，以促进网络第三方支付的有序发展。56905

Abstract: With China's growing rise of online shopping and so on, third-party payment platform, the network has developed rapidly, the existing law on the traditional pay strict legal regulation bodies, the legal regulation of third-party payment network there is a big shortfall , which for the third-party payment network constraints ineffective legal risks. In this paper, based on the actual situation in China, the connotation of the third party payment network, features are introduced, with emphasis on the legal status of third-party payment network to analyze the reasons for vulnerability and clear under the current legal system exists. Furthermore, for the payment of legal defects in the current realities of third-party networks to build targeted solutions to promote the orderly development of the network of third-party payment.
