摘要：中国改革开放已经将近四十年了，改革开放极大地促进了中国的生产力水平的提高，但是开放的沿海和内陆贫富差距很大，这在某种程度上造成了不平衡现象，进而扰乱了市场竞争秩序，借用老子的话说，天下皆知美之为美者，斯恶也，商业秘密又何尝不是，商业秘密能为拥有人带来丰厚的利益，所以商业秘密的法律保护随之产生，在竞业禁止中有规定，在商业秘密保护合同中有体现，已经不可避免地产生竞争冲突，如何最小限度地达到商业秘密等侵权行为解决方式的便捷高效，本文列举了最近几年发生的典型案例，并提出了引用判例的应对措施。20076

Abstract: With the development of China's economy step by step, constantly improve people's living standards, the commercial economy developed, the tort is also more and more, people's insecurity is also increasing, me said, everyone knows the beauty is beauty, ugliness, commercial secret and did not, the business secret can bring huge benefits for , so the legal protection of commercial secret emerged, there are provisions in the prohibition of business strife, embodied in the protection of commercial secrets of the contract, then how to minimal to tort solution convenient and efficient, so in this paper, the prohibition of business strife are briefly discussed and the present situation of commercial secrets, and published my views.
