摘 要：本文从国民政府时期、新中国成立初期、改革开放时期直至现在，分别对中国工会法的立法过程进行了研究，探讨各个时期《工会法》的立法背景，比较分析各个时期工会法的继承与发展。现阶段在贯彻实施工会法的过程中，存在着建立、健全基层工会组织困难；工会职能弱化；现行《工会法》有待完善等问题，笔者建议应该大胆推翻单一的立法模式，树立多元化的工会立法思想；重视工会，保障其独立的法律地位；减少工会法律配套制度中的漏洞，健全法律保障体系。57059

Abstract：From the period of the National Government, founding of New China, the reform and opening period until now, namely the legislative process of China's Trade Union Law was studied to explore the various periods of "Trade Union Law," the legislative background, the comparative analysis of the inheritance and development of various periods union law . Stage in the implementation process of the Trade Union Law, there is a build, improve grass-roots trade union organizations difficulties; legitimate rights and interests of workers long-infringement; existing union law and other issues need to be improved, I suggest should be bold legislation to overturn a single model, establish a persified union legislation thoughts; importance of trade unions to protect their independent legal status; reduce union legal support system vulnerabilities, improve the legal protection system.

一、引言

近百年来，工会立法逐步发展，工会立法是相对重要的一个环节，我国经历了1929年南京国民政府时期的工会法、1950年的工会法、1992年的工会法和2001年的工会法四个立法阶段。在笔者看来，在探讨这四个阶段立法过程时，也要研究一下1924年的《工会条例》，虽然它不是真正意义上的工会法，但是它对工会法的研究与立法有着重要的影响。这四个立法阶段对于我国现行《工会法》的立法研究有着不可替代的作用。

二、新中国成立以前工会立法变迁

（一）工会立法序曲

1.《工人协会法草案》

鸦片战争以后，中国的社会政策发生变革，经济制度也随之变化，封建王朝被迫解体。“北洋军阀在北洋政府建立的最初几年无视工人阶级的利益，镇压工人运动，因此他们便出台了一系列禁令，但这些出台的禁令没有能够对抗正在发展的工人运动。迫于这样无奈的情况，北洋政府在1919年改变了策略，试图达到控制工人运动的目的。北洋政府在1923年向国会提交了《工人协会法草案》。 ” 中国工会立法变迁及其启示:http://www.youerw.com/faxue/lunwen_61645.html
