摘要同性恋现象在人类发展史上由来已久，但是同性恋者长久以来都没有得到应有的公平的对待。近代以来，随着人权运动以及同性恋者争取合法地位的运动的发展，人们对于同性恋者的态度发生了改变。许多国家都通过立法来承认同性恋甚至同性婚姻的合法地位，并赋予其婚姻家庭方面的权利。这些国家关于同性婚姻的立法模式和域外效力的规定都存在着较大的区别，引发了同性婚姻的域外效力的先决、识别、法律适用等一系列国际私法问题。当前，中国以“公共秩序保留原则”为由拒绝承认同性婚姻的域外效力，但是，正视同性婚姻的域外效力问题是中国必须要做的事情。68227

Abstract
Homosexuality in the long history of human development, but homosexuals have long been not been given fair treatment. Since modern times, with the gay rights movement and the movement of gaining our rightful place of development, people's attitude to homosexuals changed. Many countries have passed legislation to recognize gay and even the legal status of same-sex marriage and give their marriage and family rights. These countries legislation on same-sex marriage patterns and extraterritorial provisions there is a big difference, same-sex marriage sparked extraterritorial precedent, identification, applicable law and a series of private international law issues. At present, China to "public order retention policy," refused to recognize same-sex marriages extraterritorial effect, however, address the extraterritorial effect of same-sex marriage issue is China must do.

1 引言
在人类几千年的发展历史中，不论是在古老的西方文明，还是神秘的东方文明中，同性恋都作为一种客观现象存在着，其在社会宗教文化的变迁中经历了复杂的生存发展历程。在世界绝大多数的宗教教义中，同性恋都被视为罪恶而被禁止。同性恋人群一直处于社会的边缘地带，忍受其它社会成员怪异的目光。但是，随着同性恋群体的日益壮大，其要求得到公平对待的诉求和呼声越来越高。同性恋现象已经从一种单一的社会亚文化现象，转变为一种新型的社会关系。随着人权运动和同性恋解放运动的兴起，同性恋者的法律地位得到了很大程度的改善，许多西方国家已经将同性恋作为一种特殊社会关系予以确认，通过立法来保护同性伴侣的结合，并赋予同性伴侣与传统婚姻中男女双方享有的相近权利。但是，不管怎么说，实现同性恋者婚姻合法化的诉求,将对传统婚姻制度提出前所未有的挑战。 同性婚姻的域外效力法律问题研究:http://www.youerw.com/faxue/lunwen_76694.html
