城市房屋征收之补偿法律问题研究 一、城市房屋征收补偿制度的概述
（一）城市房屋征收补偿的含义
城市房屋征收补偿是指房屋征收部门（通常是政府城建部门）在提前对改建土地立项的前提下对居民房屋的土地使用权进行的有偿回收。补偿是征收人对被征收人的房屋采取货币补偿或者产权调换的方式进行补偿。拆除违章建筑和超过批准期限的临时建筑，不予补偿。其目的是为了使国有土地上房屋征收和补偿活动规范，文护了公共利益，保障被征收人的合法权益的一种征收补偿行为。
 （二）城市房屋征收补偿的范围
 城市房屋征收补偿活动与被征收人的利益息息相关。近几年来对于房屋征收补偿款的纠纷越来越多，对此界定征收补偿的范围对于房屋征收补偿工作尤为重要。根据《国有土地上房屋征收与补偿条例》 第十七条规定，做出房屋征收决定的市、县级人民政府对被征收人给予的补偿包括（一）：被征收房屋价值的补偿。（二）：因征收房屋造成的搬迁、临时安置的补偿。（三）：因征收房屋造成的停产停业损失的补偿。[1] 城市房屋征收之补偿法律问题研究:http://www.youerw.com/faxue/lunwen_39620.html
