摘  要：2014年5月1日正式实施的《中华人民共和国消费者权益保护法》，修改了之前《消法》中的一些不足，变化比较大的是新法55条关于惩罚性赔偿的规定。但自新法实施以来，惩罚性赔偿制度的适用在实践中遇到了难题，比如关于消费者主体资格的认定，欺诈行为的判断标准以及惩罚性赔偿基数的确定等。由于法律没有明确规定，各法院依据自己的理解判案，造成了同案不同判的现象。完善惩罚性赔偿制度的不足，既可以给司法实践带来方便，以可以更好地发挥惩罚性赔偿制度的作用，保护消费者的合法权益。74765

On the "Consumer Protection Law" in the system of punitive damages

Abstract:“New Law of the PRC on the Protection of the Rights and Interests of Consumers”(hereinafter referred to as the "Consumer Law") were effective formally as of May 1, 2014。 It revised some shortcomings of the previous one and showed great changes in the article 55 on Punitive Damages。But since the implementation of the new law,the Punitive Damages had had difficulty in practicing, such as the identification of the Qualification of Consumer Subject, the judgment standard of fraud, the deciding of the base of the punitive damages and so on。 Every court decides cases according to their own law for the lack of the clear law which results in the phenomenon that co-case is connected with different decisions。 Perfecting the shortcomings of the Punitive Damage System, it can give convenience to the Judicial Practice and play a better role in bringing the Punitive Damage into force so as to protect the legitimate rights and interests of consumers。

一、引言

惩罚性赔偿制度源于英国确立于美国，目的是为了惩罚不法行为人并威慑其他行为可能做出类似行为的人。大陆法系国家开始不仅没有此制度，还有抵触的心里，不允许在私人诉讼领域适用惩罚性赔偿，后来有些大陆法系国家渐渐接受并在本国的法律上确定了该制度。我国2014年5月1日实施的《消法》 进一步完善了我国的惩罚性赔偿制度，具有承前启后的制度变迁意义，但总是有不足的地方。本文从裁判文书网上搜集大量的民事判决书，对其进行分类解读，归纳法院判决不能适用惩罚性赔偿的理由，从中分析出现行《消法》中惩罚性赔偿制度的不足。文中选了三篇裁判文书，通过对具体案件的分析，看到我国惩罚性制度的不足，并针对不足提出一些个人的见解。 论《消费者权益保护法》中惩罚性赔偿制度:http://www.youerw.com/faxue/lunwen_85445.html
