摘要随着国际知识产权贸易的不断发展壮大，知识经济在贸易中的占比越来越大。发达国家利用自身先进的知识产权对我国设置了各种贸易壁垒不说，还以此为武器攻击我国跨国企业。我国跨国企业在知识产权方面尚未深入，经常遭到发达国家对知识产权侵权的恶意起诉而不敢反抗，就连国内企业也开始遭到发达国家跨国公司的毒手。国际知识产权保护规则过于严苛导致我国站劣势，与此同时，当国内的知识产权纠纷涉及外国企业时，我国还要考虑到国际友好、承受关于各国媒体对于我国实行地方保护的舆论压力。中国作为发展大国，应该看到知识产权在贸易中的重要性，加强对知识产权的保护，完善知识产权法律体系，在国际市场上发挥主导优势。77290
本文基于上述国际背景，通过对正泰集团与施耐德的知识产权侵权纠纷这一案例的分析，找出在与贸易有关的知识产权保护方面中国企业存在问题。以正泰集团案例为典型，从中汲取经验，提出相应的对策。希望能给中国企业在知识产权贸易纠纷上再遇刁难时提供一些参考。

Trade-related intellectual property protection research - focus on Chint group case
Abstract With the development of international intellectual property trade, knowledge economy has claimed an ever-growing share of trade。 Developed countries use their advanced intellectual property set up all kinds of trade barriers to our country, and use international intellectual property as a weapon against multinational companies in China。 The multinational companies in China do not know a lot about intellectual property rights, suffering from infringement of intellectual property malicious prosecution by developed countries and do not have the capabilities to resist。 Even the domestic companies are suffering the consequences from the multinational companies in developed countries。 The stringent international protection of intellectual property rights system makes our country vulnerable。 At the same time, when the domestic intellectual property disputes involving foreign companies, our country have to take the international friendship into consideration and under pressure about local protection in China from foreign media public。 As a big developing country, China should see the importance of intellectual property rights in the trade, strengthen the protection of intellectual property rights, perfect the intellectual property law system, to play a leading edge in the international market。
Based on the international background, in this paper, aim to find out the problem with trade related intellectual property rights through the analysis of the case between the Chint group and Schneider。 Use Chint group for typical cases, learn from experience and put forward the corresponding countermeasures。 Hope that can provide some reference to Chinese enterprises when they meet difficulties on intellectual property rights trade disputes again。
