摘  要：如今我国在宅基地使用权流转方面存在着很多的问题，如我国农村宅基地使用权流转制度本身就有着许多漏洞，制度本身之间也暗藏着很多的矛盾。此外，制度在运行过程中也存在这许许多多的问题。本论文会找出问题，找出之所以出现这些问题的原因，如立法制度存在缺陷，政府部门未尽到其应有的职能，农民的受传统思想观念影响，并提出相应的完善方案。79182

On the Existing Problems and Solutions of the Transfer of Rural Residential Land Use Right in China

Abstract：The right to use the homestead refers to the rights of the members of the rural collective economic organizations to build inpidual houses on the land owned by the peasants in accordance with the law。 According to the provisions of the property law of our country, the land use right holder shall have the right to possess and use the land owned by the collective in accordance with the law, and have the right to use the land to build houses and their ancillary facilities。 There are many problems in the current rural residential land use right transfer system in our country, such as the circulation system of rural residential land use right in our country, there are many loopholes, there are many contradictions between the system itself。 In addition, the system also has many problems in the process of operation。 In this paper, we will reveal the specific problems existing in the circulation system of the rural residential land use right in our country, and analyze the reasons for these problems, and put forward effective solutions to these problems。
