摘  要：彩礼在我国古代一直扮演着举足轻重的角色，即便是在当今社会，其生命力依然旺盛。由于社会在不断的发展，与之相关的社会关系也渐趋复杂，因为彩礼的返还问题，也造成了极多的社会纠纷。由于我国有关彩礼的相关法律制度还很不完善，这就造成了人民法院在审理此类案件时遇到很多问题。这一类问题若不能够得到妥善的处理，将会严重损害当事人的合法利益，同时也会影响社会的稳定与和谐。本文将会从彩礼的法律性质着手，探讨《婚姻法司法解释（二）》，分析彩礼返还，并总结其中不足之处，以及实践中可能出现的问题，借鉴国外的立法经验，将过错责任引入我国立法，以期能够完善我国的彩礼返还制度。79181

A study on related problems of betrothal gifts

Abstract: Betrothal gifts in ancient China has been playing an important role, even in today's society, its vitality is still strong。 Because of the social development, and the related social relations has become increasingly complex, because the return of betrothal gifts, also caused a lot of social disputes。 The related legal system of our country is about betrothal gifts it is not perfect, it will cause people's court to meet a lot of problems in the trial of such cases。 This kind of problem if not properly handled, will seriously damage the legitimate interests of the parties, but also affect the stability and harmony of the society。 This paper will start from the legal nature of betrothal gifts, to explore the "marriage law judicial interpretation (two)", analysis of the return of bride price system, and summarizes the deficiencies and possible problems in the practice, learn from foreign legislative experience, the introduction of fault liability legislation in our country, In order to improve China's price return system。

一、引言

早在西周时期彩礼便已经存在，随着时间的流逝，彩礼也在不断的发展，在社会生活中起着非同一般的作用。虽然我国出台的《婚姻法》中并未将其纳入其中，可是其作为百姓的民俗也并未因此而受到波澜。正因为它重要，因彩礼问题而产生的社会矛盾、社会纠纷也在逐渐增加。《婚姻法》对彩礼问题没有明确的规定，给法院审理案件造成了困难，这是立法上的不足；[ 谢广利。彩礼返还问题的法律规制[J]。黑河期刊，2015。]为解决这种问题，《婚姻法解释（二）》第十条出台了，但是现实情况太过繁杂，彩礼返还制度只凭一条书面的规定肯定不够。它的出台不仅增加了审理的难度，而且也因法官有自由裁量权，可能造成案件审理结果不一致，使法律缺乏统一性与权威性。因此，笔者想通过对彩礼的渊源与发展、法律性质以及各国有关彩礼方面的立法和学说进行一定的分析，比对国内外立法，找出彩礼返还制度的不足之处，然后对彩礼返还制度的完善提出建议。论文网 彩礼返还制度研究:http://www.youerw.com/faxue/lunwen_91469.html
