摘要本文在对已有验证中国“污染天堂假说”的相关文献进行回顾的基础上，对环境管制强度与外商来华FDI决策的影响进行了研究。通过构建一个包含环境管制强度及各地区发达程度的分析模型，并利用2000年至今的数据进行实证研究。研究发现，环境管制力度对我国吸引外商来华投资具有显著的影响，且环境管制强度越强，对外商投资的阻碍作用越强。这表明中国在一定程度上是存在着“污染避难所”的现象，但是这种现象在不同地区存在着差异性。地区的发展程度也对外商来华FDI决策有一定的促进作用。这表明中国环境管制虽然对外商的FDI存在显著影响，但各个地区的FDI量还受到地区发展程度的制约。因此我国应该分地区适当调整环境管制程度。如在东部地区将强管制，中部地区将环境管制力度和FDI相权衡以达到最大效益。而在西部地区，要想谋求发展，还是要着眼于提升地区的发展程度，同时，我国应该实行自主创新政策，实现本国经济的发展，和他国建立贸易共赢关系。51717

Abstract After reviewing on the existing literature to validating the "pollution heaven hypothesis" of China, we studied on the affection from environmental regulation to foreign decisions on FDI in China. By constructing a model with environmental regulation and regional development level contained, we have done empirical research based on the database since the year 2000. The research found that the strength of controlling our environment to attract foreign investment has a significant impact on FDI, and stronger the regulation is, the stronger impediment to foreign investment. This shows that to some extent, "pollution heaven" phenomenon was exists in China, but in different regions this phenomenon exist differences. The development of the region promoted the FDI decision of foreign businesses in different extent. This suggested that Chinese environmental regulation, although significantly affected by the presence of foreign FDI, but the amount of FDI in all regions also restricted by the regional development degree. This suggests that China should adjust the sub-regional level environmental regulation. As in the eastern region will be stronger control of the central region and the intensity of environmental regulation weighed against the FDI in order to achieve maximum efficiency. In the western region, in order to seek development, or to focus on improving the degree of development of the very region, at the same time, China's indigenous innovation policies should be implemented to achieve the country's economic development, and establish an win-win trade relations with other countries.
