摘要：植物新品种的培育是很复杂的过程，科研单位以及育种人既要有需要过硬的专业知识和熟练的技术，而且人力资源、物质资源和大量的资金也是必不可少的。通常情况下，想要培育出遗传性状较为稳定、生物学性状较为理想、抗病虫性、抗寒性、抗旱性等各方面都符合大批量生产要求的优质新品种，选育时间一般需要10至15年。显而易见，每一个植物新品种的培育都汇聚者育种人以及科研工作者的辛勤劳动和很大心血。所以，为了确保育种者的权利不受侵害，并且从根本上激发他们培育植物新品种的积极性，必须要对植物新品种实行必要的保护措施。本文对2000年-2010年以来，我国尤其是河南省的植物新品种申请权以及授权数据进行汇总、比较分析，针对我省植物保护工作中存在的申请及授权总量虽逐年上升但申请授权主题结构失衡等问题，提出了相关意见及要求，我省应加强植物品种保护意识，并适当采取激励政策；严格遵守《中华人民共和国植物新品种保护条例》，提高行政执法水平;同时应加大植物品种更趋丰富的力度，优化失衡的品种结构。35624

Protection of New Plant Varieties, Application Present Situation and the Industrial Development in Henan Province
Abstract: Breeding new varieties of plant is a very complex process, The breeders not only needs certain professional knowledge and technology ,but also manpower, material resources and capital investment. The product has a relatively stable genetic traits and relative consistency of  biology. The conditions of cultivation, and in a certain region, in such aspects as production, quality, resistance to diseases and pests that met the need of the production of new varieties will need about 10 to 15 years and even longer. Therefore, in order to protect the rights of breeders, arouse their enthusiasm and creativity, new plant varieties must be protected. In this paper, the rights and authorization data of the new plant varieties in China of the 2000-2010 especially in Henan province was summarized, comparatively analyzed. There are many problems in the work of plant protection in our province, such as the application and authorization amount is rising year by year, but the authorization theme structural is imbalances, to solve it, we put forward some opinions and requirements: we should strengthen the consciousness of the plant varieties protection and adopt appropriate incentives; We must strictly comply with the new plant varieties protection ordinance of the People's Republic of China and improve the level of administrative law enforcement; At the same time, We should intensify the efforts to make the plant varieties more abundant and optimize the structure of the varieties imbalances.
