摘要:在全球建筑工程日益复杂和工程量不断增加的背景下,承包商面临的索赔问题也更加层出不穷。如何通过有效得索赔手段文护承包商权益、弥补损失和提高经济效益成为当今一个严峻的话题。37700
论文认为承包商的索赔是一个细致,繁琐的过程,具有其独特的复杂性,从承包商的角度出发,策划一个精细的索赔系统,深入研究索赔发生的原因、发起索赔的策略与方法。针对工程施工过程中发生的索赔问题,从工程施工索赔与项目管理其它职能的关系,工程索赔的主要项目内容,索赔的过程,索赔的实现等几个方面进行探索,定量分析索赔难点问题所在:承包商工期索赔和费用索赔,给出索赔原则及计算方法。以利用在今后的工作中,合理控制工程造价,尽量防止和避免工程索赔的发生,做好对承包商的索赔工作。
论文探索性的重新规划索赔管理机构,构建矩阵型索赔组织结构模型,通过设置索赔领导小组,设立三阶级管理人员,纵向对索赔全过程工作进行领导管理,满足了索赔管理所需要的合同等各职能部门的横向协作,又满足了纵向管理的需要。
本文创新点在于:基于原有的索赔流程,通过索赔管理机构的运行机制,建立新的承包商索赔实务流程,具体研究承包商索赔的全过程,给出承包商索赔过程中面临争议的解决办法,充分把握承包商在索赔中的主动性和灵活性。

Abstract:Under the background of increasingly complex global construction and engineering projects increasing the amount, contractor claims issues faced more endless. How to safeguard the interests of contractors have claims through an effective means to make up for the loss and improve economic efficiency become a serious topic.
The Article finds that the Contractors’ claimant is a course of meticulous, tedious, has its own unique complexity, from the contractor's point of view, we must plan an elaborate claims system, in-depth study of the reasons of a claim, the claim initiated strategies and methods . For claims issues occur during construction, and several aspects of project construction claim from the other functions and project management relations, the main project content claims, process claims, and claims realization exploration, quantitative analysis of the difficulties claims the problem: duration contractor claims and expenses claims, claims principles and calculation methods are given. To take advantage of the future work, the reasonable control of the project cost, try to prevent and avoid the occurrence of project claim, to do the work of contractors’ claims.
The Article exploratory to afresh claims management agency, construct matrix organizational structure model of claims, claims by providing the leading group, set up three class management personnel, the whole process of longitudinally claims for leadership, management to meet the contract and other claims management needs horizontal collaboration functions, but also to meet the needs of vertical management.
The Article innovation lies based on the existing claims process, through the claims management organization operating mechanism, establishment of a new contractor claim in the process, give the contractor the claims process faced dispute settlement, take full advantage of the initiative and flexibility in the Contractor's claims .
