两会已经结束,全国人大常委会委员长吴X国表示,将推进社会领域立法,包括修改《劳动合同法》。由全国人大法工委主持起草的《<劳动合同法>修改方案(征求意见稿)》已于3月底形成,目前正在进一步征求相关部委、专家的修改意见,其中针对劳务派遣将违规劳务派遣单位处罚标准提高,并且违反劳务派遣“三性”的用工单位也将受到相同额度的处罚。近年来劳务派遣已成为重要的用工模式之一,本文立足于我国劳务派遣发展的现状和存在的问题进行研究,从而提出企业防范风险以及我国劳务派遣制度完善的几点建议。希望对我国企业劳务派遣制度的实践和理论的发展尽绵薄之力。6632

Title Research on the legal system of enterprise labor dispatching
Abstract
Two sessions of 2012 have ended.Wu Bangguo,the chairman of the NPC Standing Committee said that our country will promote social legilation this year,including the modification of Labor Contract Law.Drafted under the auspices of the NPC Law Committee, "Labor Contract Law to amend the proposal (draft)" has been formed in the end of March.It is saught further comments
of relevant ministries and experts currently. When it comes to Service Dispatching, the penalty standard on labor dispatch organizations where violation of the law is increased. Meanwhile, the same amount of penalty will also applicable to those organizations where violation the Service Dispatching. Labor dispatching has been one type of important employing modes in this years.The research of this article is based on the present situation and extant problems of the develoment of labor dispatching in China,and therefore it makes some suggestions that enterprises how to prevent risks and that our country how to consummate labor dispatching.I hope that it can be of benefit to the development of practice and theory of China’s legal system of enterprise labor dispatching.
