摘 要：改革开放以来随着经济社会的不断发展，我国已经形成了市场化的劳动关系、劳动者和用人单位之间的矛盾也日益显现，劳动者越来越重视自身的权益的维护，为了更好的维护劳动者的合法权益，协调劳动者和用人单位之间的关系，我国建立了集体合同制度，集体合同经过这么多年的发展，已经日益成熟，原来的《集体合同规定》已经不能适应社会的发展，我国迫切要求对集体合同制度进行立法。本文旨在通过对集体合同制度的现状和《集体合同规定》的不足之处进行分析，对多个域外国家《集体合同法》立法进行借鉴，并针对我国集体合同制度立法提出自己的建议：加强用人单位的责任限制、加强集体合同内容的实效性、完善谈判争议发生后的仲裁和诉讼的法律依据、加强政府在集体合同中的积极作用。54727

Abstract：Along with our country reform and opening up and development of the socialist market economy, our country has already formed the market-based labor relation, the contradiction between the laborer and unit of choose and employ persons also appeared increasingly, workers pay more and more attention to their own rights and interests of the maintenance, in order to better protect the lawful rights and interests of workers, to coordinate the relationship between the laborer and unit of choose and employ persons, the collective contract system is established in our country, the collective contract after so many years of development, has been increasingly mature, the original "collective contract" already can not adapt to the development of the society, the demands for collective contract legislation of our country. This paper aims at analyzing the situation and reasons of the collective contract system, to many foreign countries "collective contract law" legislation is analyzed, and the collective contract system in our country legislation put forward their suggestions.

一、 引言

随着改革开放的逐步深入，中国的经济社会得到了前所未有的发展，伴随着市场化以及工业化的不断推进，不同类型的企业不断出现，也同时出现了越来越壮大的工人群体，繁荣的市场经济尽管给国家和社会带来无限的活力，但也免不了出现和产生一系列问题。而劳资关系却成为制约我国经济发展和社会稳定的重要问题。逐渐增加的劳资纠纷和利益冲突，使劳资双方的关系越来越紧张。与此同时，做为调解企业和职工关系、增进双方理解、防范双方争议冲突、解决双方劳资纠纷有利武器的集体合同制度在我国得到了快速发展。
