摘要：恶意透支作为信用卡诈骗罪的一种表现形式，它与信用卡诈骗罪其他三种表现形式在主体性质社会危害性等方面存在很大的不同，我国经济发展较某些国家比较落后，所以在法律体制也会存在很多不成熟的的地方，刑法中信用卡犯罪相应立法起步较晚，相应的法律理论的研究也就不成熟，导致在办理信用卡犯罪的时候对信用卡诈骗罪认识不足，在法律适用问题上产生争议。本文针对信用卡透支罪中的恶意透支行为并结合理论界的不同观点以及司法实践中遇到的案例展开论述，分析了恶意透支可以独立成罪的具体原因以及可以独立成罪的可行性，并且给出了相关的立法建议。56714

1 恶意透支行为的概述

恶意透支作为信用卡诈骗罪的一种表现形式，无论从其主体还是其性质，社会危害性等方面都与使用伪造，作废的信用卡以及冒用合法持卡人的信用卡有一定的理论性差异，所以恶意透支有必要单独为其设立一项独立的罪名，这样才能更好地完善立法司法的体系，提高司法实践效率。首先我们从恶意透支的概念的特征开始分析。
