摘要：改革开放以来中国的社会经济飞速发展，国民的生活水平不断提高，私家车也逐渐走入寻常百姓家。社会经济的发展在带动人们消费水平不断提高的同时，也带来了一些问题。例如随着私家车数量的增多，伴随而来的是小区车位的供不应求。法律在伴随着社会经济发展的同时也在不断的完善，我国的《物权法》和最高人民法院公布的“关于建筑物区分所有权”的司法解释，为解决相关法律争执提供了一定的法律依据。本文结合现实生活中的小区车位的具体表现形式，归纳总结车位归属的有关学说，通过参考有关家或者地区的一些立法来完善我国小区内的车位制度，明确其所有权，期待真正实现平定纠纷、制止争议的效果。64074
