摘 要:在城市商品房价格对很多人来说都是高不可攀的情况下,购房人往往将目光投向地处在城市与农村之间的小产权房,相关部门亦曾多次发布提示告知公众小产权房的法律风险。当地的有关建设部门也都采取行动,拆除小产权房。然而,部分学者、有购房需要的人、小产权房的持有者则认为小产权房当前的存在状况证明其具有切实的社会需要,并根据该需要阐述了小产权房有无合法化的机会。我国部分地区已经着手试点解决小产权房的产权问题,使小产权房不再只有小产权,小产权房问题受到普遍关注。本文将从小产权房的概念、特征开始介绍,通过分析小产权房的困境、风险,最后提出小产权房问题的解决途径。65029

1 小产权房的概述
1.1 小产权房的概念
所谓的“小产权房”,并不是权威的具有说服力的一种定义,它基本来自于因特网、杂志报纸等各式各样的正式及非正式的渠道宣传。在机关文件和报告当中也频频出现“小产权房”。除此之外,许多学者专家、从事法务工作的法官、律师以及我国广大的百姓群众也都频频谈及“小产权房”。
我国在目前并不存在“小产权房”的一致的、完善的界定,可以认为“小产权房”这个术语本身并不是正规完善的。我认为可以将“小产权房”理解成:农村的集体组织、农村个人或者是从事房地产投资的商人在农村集体土地建造、销售的房屋。
