论TPP和WTO的冲突及其协调商标规范为例

摘要通过比较TPP和TRIPS协定的商标权规范，发现TPP相较于TRIPS协定增加了新的商标权客体，对驰名商标的保护标准也有所提高，地理标志的保护手段更加多元化，同时还增加了商标电子系统等要求。在此基础之上，总结出TPP和TRIPS协定的商标规范之间存在四种关系，即TPP商标规范直接引用或实质性细化了TRIPS协定既有规则，选择性忽略TRIPS协定既有规则以及创造性纳入了TRIPS协定缺失的规则。其中，两者的冲突主要集中在实质性细化、选择性忽略和创造性纳入三个方面。运用国际法原理来协调二者的冲突，首先，需要通过条约解释的方法来确定实际冲突。其次，通过条约中的“冲突条款”来解决TPP协议意识到的冲突。最后，通过特别法优先原则来协调TPP和WTO商标规范的其他的冲突。使得国际知识产权保护规则更加适应现今社会的发展并不断完善。87715

Title Theory on Conflict and Coordination of TPP and the WTO： from the Perspective of the Rules of Trademark Protection

Abstract By comparing the TPP and the TRIPS Agreement trademark rights norms, it was found that TPP added new trademark object , the protection of well-known trademarks standard also increased, means of protection of geographical indications became more persified, but also increased the trademark electronic systems and other requirements compared with the TRIPS Agreement。 On this basis, summed up there are four relationships between TPP and TRIPS Agreement trademarks specification, that is TPP trademarks referenced directly or richly detailed specification of the existing rules of the TRIPS Agreement, selectively ignore the existing rules of the TRIPS Agreement as well as creatively incorporated rules not included in the TRIPS Agreement。 Among them, the conflict mainly concentrated in richly detailing, and selectively ignoring as well as creatively incorporating three aspects。 Using the principle of international law to coordinate the conflict between the two agreements, first of all, we need to determine the actual conflict by treaty interpretation methods。 Secondly, using the "conflict clause" of treaty to resolve the conflict that TPP agreement already realized。 Finally, to coordinate the other conflicts of WTO and TPP trademark norms we can use special law priority principle。
