网络言论的法律规制方式研究

摘要科学技术的高速发展使得人们通过互联网能够更为方便地获取信息、发表意见。由此言论的内涵有所发展，逐渐向网络虚拟空间进行延展。但网络言论所具有的新特点要求政府在规制网络言论时不能简单地照搬对传统言论的规制方式，因此需要在传统法律的基础上对网络言论的规制方式进行创新。87789

本文分四个部分。第一部分对网络言论的特征及其法律规制的必要性进行分析；第二部分指明了我国对网络言论法律规制的措施并分析其存在问题；第三部分对相关域外法律进行了介绍；第四部分对我国现行网络言论法律规制方式的完善进行了思考。文章最后对全文进行总结与慨括。

Title Research on the legal regulation of speech on the Web

Abstract The rapid development of science and technology made it through the Internet to more easily access information, to express their views。 Connotation of speech development, gradually extended to virtual space。 But the new characteristics of speech on the Web urging the Government in regulating speech on the Web cannot be simply transposed to regulation of traditional expression, therefore need to be based on the traditional laws of innovation to regulation of speech on the Web。

This paper is pided into four parts。 First part of network characteristics and the need for legal regulation of speech analysis; the second part indicates a measure of legal regulation of speech on the Web in China and analysis of its problems; the third part introduces the extraterritorial laws part of our current thinking about the perfection of the legal regulation of speech on the Web。 Finally we summarize with money enclosed。
