摘要从人类社会有了诉讼这一纠纷解决机制开始，证据便成为诉讼的核心内容之一 。举证责任的承担与分配决定了诉讼如何进行，向哪个方向进行等问题。有时候甚至可以认为举证责任决定了诉讼结果有利于哪一方。在医疗诉讼领域，举证责任的基本原则依然保持着“谁主张，谁举证”这一原始风貌。本文为了详细分析举证责任的分配与适用的相关内容，选择医疗纠纷损害赔偿这一领域进行有针对性的分析。本课题基于医疗损害赔偿举证责任的理论概述的基础，分析医疗侵权举证责任的分配与适用现状，探讨医疗侵权举证责任分配过错和因果关系，并进一步提出我国医疗侵权诉讼举证责任的分配与适用的建议。87832
