摘要物权法司法解释（一）限制了特殊动产物权变动中善意第三人的范围，受让人已经取得 占有并支付对价情况下的一般债权人被排除在善意第三人范围之外。但关于善意第三人的范 围仍不够具体清晰，因此本文借鉴日本学界对于第三人范围的有关学说，并结合我国实际情 况，对登记对抗主义的本意稍作分析，从客观抽象标准，主观标准以及具体标准三个层次对 善意第三人的范围进行分析，从而对我国特殊动产物权变动中的善意第三人加以界定。89022
