摘要随着社会的不断发展和科学技术的不断进步，我国的冷冻胚胎生殖技术也日趋成熟。然 而，由于现阶段我国缺乏相应的法律规定，与冷冻胚胎相关的一系列问题成为司法实践中亟 需面对的新难题。本文在介绍“无锡冷冻胚胎继承案”的基础上，对冷冻胚胎的法律属性进 行深入探究，肯定了“折中说”，并深入探究冷冻胚胎的所有权归属问题以及继承权问题， 最后针对冷冻胚胎的处置方式提出相应的合理化建议。89055

Abstract: With the continuous development of society and the progress of science and technology, the reproductive technology of frozen embryos in China is also becoming mature gradually。 However, at present stage, a series of issues related to frozen embryos has become the new challenge in the judicial practice, due to the lack of legal provisions in our country。 In this paper, on the basis of the introduction "Wuxi frozen embryo inheritance case", it delves into the legal attribute of frozen embryos, affirms the "compromise theory", explores the issue of frozen embryos on the rights of ownership and inheritance, and finally puts forward the corresponding rationalization proposals direct at disposal methods of frozen embryos。
