摘    要想要对体育赛事电视转播权的法律性质进行定性，首先要对体育赛事的法律性质进行定性，即体育赛事是否属于著作权法意义上的作品。根据著作权法意义上的作品必须具备的四个条件判断，体育技艺表演、舞蹈型体育竞赛表演和杂技型体育竞赛表演应该认定为著作权法意义上的作品，除此之外的绝大部分体育赛事不属于著作权法意义上的作品。关于体育赛事电视转播权的法律性质笔者认为“作品”型体育赛事电视转播权属于表演者权，“非作品”型体育赛事电视转播权属于“类表演者权”。正因为这样，我国现行《著作权法》无法对体育赛事电视转播权进行有效保护，需要在《著作权法》中明确规定体育赛事电视转播权的含义、体育赛事电视转播权转让合同的内容，完善合理使用制度，以便对体育赛事转播权进行有效保护。90287

It is necessary to qualify the legal nature of sports events at first if we want to qualify the legal nature of the sports TV broadcasting rights。 It means we should figure out whether the sport events belong to the work of copyright law。 According to the four necessary conditions to make up the work of the copyright law, sports skills performances, dance sports competition performances and acrobatic sports competitions should be identified as the work of copyright law。 In addition to these three sports types, majority of sports events does not belong to the work of copyright law。 On the legal nature of the sports TV broadcasting rights, I think that "works" type sports TV broadcasting rights are performer rights, "non-works" type sports TV broadcasting rights are "similar performer rights"。 Because of this, China's current Copyright Law can not effectively protect the sports TV broadcasting rights。 We need to clear the meaning of the sports TV broadcasting rights, set the sports TV broadcasting rights transfer contracts contents, improve the system of reasonable use in the Copyright Law in order to effectively protect the sports TV broadcasting rights。
