摘 要 随着民主法治的发展和社会人文及科技的进步，过去不被接受的某些观点也获得了人们的接纳，其中，同性婚姻合法化尤其惹人注目。同性婚姻(或称为"同性恋婚姻"或"同性别婚姻")是指生理性别或性别认同相同的两人之间的婚姻关系。近年来同性婚姻合法化在国际舞台上大放异彩，许多国家对同性婚姻进行了合法化立法，但在中国同性恋及同性婚姻合法化研究仍旧非常落后。作为拥有最大人口基数的中国，同性恋人口数量较多。而相关的法律规定却比较空白，直到现在许多国人对同性恋者仍旧持有偏见。为此，对同性婚姻合法化的法理探究及同性恋的具体问题进行研究具有极大的迫切性。为此，我希望在本文对同性恋者的形成原因和特征进行解读，同时借鉴西方对同性婚姻合法化案件，以此与中国进行比较，同时从法理人伦角度，思考表达同性婚姻合法化在中国是否有进行的必要，希望对中国法治和人权建设提供力所能及的支持。90344
