第三方电商平台下知识产权案件的管辖权归属

摘要

第三方电子商务平台的兴起和高速发展背后存在大量知识产权侵权问题。与传统管辖权争议相较而言,受案法院在确定该类新型管辖权争议时有不同的理解,存在着以第三方电子商务平台公司所在地为依据、以涉嫌侵权人所在地为依据、以侵权行为地依据确定管辖权等多种观点，司法实践中较为混乱。因此，如何明确第三方电子商务平台下知识产权纠纷的管辖权问题亟待解决。通过本文对我国法院裁定的此类管辖权纠纷案件的初步梳理，结合管辖权的原则分析，笔者认为，健全知识产权法院的专属管辖是解决此类问题的有效途径，同时是否引进不方便法院原则也值得我们进一步思考，当然目前的司法环境并不成熟，建立以第三方电子商务平台所在地为优先管辖的技术有限管辖规则，可以为解决此类案件中管辖权认定困难提供过渡。 85179
