摘 要：近年来，随着金融和互联网通信的快速发展，人们通信方式愈加多样。人们在享受着多样化通信方式带来生活便捷的同时，社会也产生了令人普遍谈之色变的问题—电信诈骗。伴随着个人信息的泄露和虚假信息的爆炸式产生，电信诈骗在我国呈现出燎原之势迅速蔓延。电信诈骗给国家和人民造成了巨大的损失的同时，也成了为一个不可忽视并且亟待解决的社会问题。本文拟从法律角度剖析我国现阶段的电信诈骗问题，首先从分析我国电信诈骗犯罪现状入手，分析电信诈骗的特点、犯罪手段等，并且结合我国法律和社会现实，为我国电信诈骗的法律规制提出相应的对策。90857

The present situation and countermeasure research of telecom fraud crime in our country
Abstract: In recent years, with the financial and the rapid development of Internet communication, people communicate more and more perse。 When more persified communication way to bring people life convenient at the same time, also brought social common now for people to talk about the problem of the telecom fraud。 Along with personal information leakage and false information explosion, telecom fraud in our country presents the fire spread quickly。 Telecom fraud caused huge losses to the people and the country at the same time, also became to a can not be ignored and social problems to be solved。 According to statistics, in 2015 the national public security organs kyoritsu telecom fraud cases 590000, a total economic loss of 22。2 billion yuan。 In the first quarter of 2016, the country received SMS fraud 640 million person-time, fraud phone dial the number 1。01 billion。 Telecom fraud in China for many years witnessed a rapid increase。 This paper tries to analyze the current situation of telecom fraud crime, combining the reality of law and society, propose solutions on the solution of the telecom fraud in China。
